What do you need to know about search and seizure?

The Fourth Amendment to the U.S. Constitution protects citizens from unreasonable (search) of their property and persons, and prohibits police officers from making unlawful arrests (seizures). Although this may seem straightforward, it is unreasonable and naïve for you to think that all police officers follow the law.

The fourth amendment is the number one constitutional right police officer violate. This violation happens 8 times out of 10 when ever a police officer does a stop and frisk. Why should I take this course?

Quite frankly because you do not know it. Do you know how many times a day a person’s fourth amendment rights are violated, over 1,000,000 times a day throughout this country on average?

This happens for three reasons, police officers do not know it, police officers do not care about it, and because you do not know it. During our Founder, Milford Hayes years of law enforcement, he doesn’t recall how many times he responded to a call and the number one statement he continually received from the citizens as he was trying to do his job was “I know my rights”, when in fact they did not. This lack of knowledge caused the citizen to resist or hinder an officer from doing their lawful duty and was arrested.

We’ve seen too many people voluntarily waive their fourth amendment rights for the purpose of proving they are innocent and have nothing to hide. Thinking that this will cause the Traffic stop or Detention on the street, to go faster, to prevent a stop from escalating, that was your thought, until you unknowingly met up with one of the many bad apples in law enforcement. Who lacks the training, education, and integrity to be enforcing the law?

Who will  more than happily take advantage of your voluntary consent, which means you waived your right of using the fourth amendment as a defense to suppress any evidence found that might have been illegally obtained or planted by the officer or found after you lied and said you did not have anything illegal on your person or in the vehicle.

To now find yourself in handcuffs and placed in the back of the patrol car headed to jail.



What makes this course different?

You will understand why you never under no circumstance do you ever waive any of your constitutional rights without talking to an attorney. There are too many people who have sacrificed so much to the point of being beaten, hung, set on fire, suffered K-9 attacks, and even death for their Equal Rights, not just for you to give them away thinking that it will ease the situation.

Your second reason for retaining your rights is to help your Defense Attorney strategically maintain your innocence. For it is the prosecution that has the burden of proving your guilt beyond a reasonable doubt (The highest proof to be made in a criminal court). You do not want to give the prosecution more corroborating evidence against you by voluntarily waiving away your rights.
